Welcome to the Juan de Fuca

Juan de Fuca encompasses the west coast of Vancouver Island from the community of Otter Point all the way to Port Renfrew, and also includes the geographically separate communities of East Sooke, Malahat and Willis Point. It also includes the Chatham and Discovery Islands, which lie off the east coast of Victoria, near Oak Bay.

The Juan de Fuca communities of Willis Point, Malahat, East Sooke, Otter Point, Shirley, Jordan River and Port Renfrew, and the Rural Resource Lands make up an unincorporated rural Electoral Area under the jurisdiction of the Capital Regional District (CRD). The CRD serves as local government for electoral areas and most administrative functions are handled from offices in Otter Point or Victoria. The southern half of Discovery Island is a Provincial Marine Park; the northern portion of Discovery Island, Chatham Island and its nearby islets are part of the Songhees First Nation reserve lands.

The CRD Board has established, by bylaw, a number of Commissions to provide community input into the delivery of specific CRD services in the EA's. The Board may also establish Committee's to provide advice and recommendations in relation to a CRD service or potential service.

Advisory Planning Commissions, one of which represents each community in the Juan de Fuca area, make recommendations to the CRD on community and neighbourhood development plans, zoning applications and development permits. At this time the Port Renfrew and Malahat Advisory Planning Commissions are not active. The Commissions meet on an as required basis.

Bylaw No. 4271, “Juan de Fuca Land Use Committee Bylaw No. 1, 2004, Amendment Bylaw No. 8, 2018”

The Juan de Fuca Land Use Committee (LUC) will consider proposed Bylaw No. 4271 at its December 17, 2018 meeting. Proposed Bylaw No. 4271 would amend the Juan de Fuca Land Use Committee Bylaw, Bylaw No. 3166, to update the LUC’s authority to make recommendations to the CRD Board on land use matters including retail cannabis and liquor licenses, conversion of previously occupied buildings to strata, radio-communication and broadcasting towers, and applications pertaining to land in the Agricultural Land Reserve.

Cannabis Bylaw, Bylaw No. 4278, “Juan de Fuca Land Use Bylaw, 1992, Amendment Bylaw No. 141, 2018”

The Juan de Fuca Land Use Committee (LUC) will consider proposed Bylaw No. 4278 at its December 18, 2018 meeting. Proposed Bylaw No. 4278 would amend the Juan de Fuca Land Use Bylaw, Bylaw No. 2040, to update definitions and address the legal cultivation of cannabis in the Agricultural Land Reserve (ALR).

Soil Deposit Permit Application SP000092 - Section 42, Otter District (Clark Road)

The Juan de Fuca Land Use Committee (LUC) will consider the request for a soil permit to deposit up to 20,000 cubic metres (m3) of soil on the subject property to complete creek restoration and for road construction associated with a proposed subdivision at its December 17, 2018 meeting.

Temporary Use Permit Application TP000009 - Lot 4, Section 47, Otter District, Plan VIP52344 (7861 Tugwell Road)

The Juan de Fuca Land Use Committee (LUC) considered the request for a temporary use permit to allow the expansion of a home based microbrewery in the Rural Residential 2 (RR-2) zone at its November 20, 2018 meeting. At this meeting the LUC recommended that the application be referred to agencies and the Otter Point Advisory Planning Commission.

Rezoning Applicaiton RZ000260 - Lot 9, Section 129, Sooke District, Plan VIP67208 (590 Seedtree Road)

The Juan de Fuca Land Use Committee (LUC) considered the request to rezone the subject property from Rural A to Rural Residential 6A (RR-6A) for the purpose of permitting a 4-lot bare land subdivision as an alternative to a building strata development (proposed Bylaw No. 4265) at its November 20, 2018 meeting. At this meeting the LUC recommended that proposed Bylaw No. 4265 be referred to agencies, the East Sooke Advisory Planning Commission and the Juan de Fuca Electoral Area Parks and Recreation Advisory Commission.

Rezoning Application RZ000259 - That Part of Lot 2, Section 90, Renfrew District, VIP6764 Lying to the North of the 66 Foot Road Dedicated by Said Plan (9330 Invermuir Road)

The Juan de Fuca Land Use Committee (LUC) considered the request to rezone the subject property from Rural (A) and Forestry (AF) to Agricultural (AG) for the purpose of permitting farming (proposed Bylaw No. 4259) at its October 9, 2018 meeting. At this meeting the LUC directed referral of proposed Bylaw No. 4259 to agencies and the Shirley/Jordan River Advisory Planning Commission.

The Shirley/Jordan River Advisory Planning Commission considered the application at its November 7, 2018 meeting.

Rezoning Application RZ000258 - Lot 2, Section 95, Sooke District, Plan 45068 (1021 Parkheights Drive)

The Juan de Fuca Land Use Committee (LUC) considered the request to rezone the subject property from Rural Residential 3 (RR-3) to Rural Residential 6A (RR-6A) to permit a 2-lot subdivision at its September 18, 2018 meeting. At this meeting the LUC recommended that proposed Bylaw No. 4260 be referred to agencies and to a public information meeting.

A public information meeting was held at the East Sooke Community Hall on October 10, 2018.

Rezoning Application RZ000257 - Strata Lot 10, Section 16, Otter District, Plan VIS7096 (7450 Butler Road)

The Juan de Fuca Land Use Committee (LUC) will consider the request to rezone the subject property from the General Industrial (M-2) zone to the General Industrial – Medical Marihuana (M-2MM) zone in order to permit a licensed medical cannabis cultivation facility pursuant to Health Canada’s former Access to Cannabis for Medical Purposes Regulations (ACMPR) at its December 17, 2018 meeting.

Rezoning Application RZ000256 - Lot 1, Section 128, Sooke District, Plan VIP58851 (5480, 5488 & 5494 Mt. Matheson Road)

The Juan de Fuca Land Use Committee (LUC) considered the request to rezone the subject property from Rural A to Rural Residential 6A (RR-6A) to permit a 3-lot subdivision for the purpose of granting individual title to each dwelling unit currently located on the property at its September 18, 2018 meeting. At this meeting the LUC recommended that proposed Bylaw No. 4257 be referred to agencies and to a public information meeting.

The Juan de Fuca Electoral Area Parks and Recreation Advisory Commission considered the application at its meeting of September 25, 2018.

A public information meeting was held at the East Sooke Community Hall on October 10, 2018.

The LUC will consider recommending that Bylaw No. 4257 be given first and second reading and direction to proceed to public hearing at its meeting of November 20, 2018.

Rezoning Application RZ000255 - Strata Lots 13, 26 & 27, Section 17, Otter District, VIS7096 (Sooke Business Park - 7450 Butler Road)

An application has been received to rezone three properties from General Industrial (M-2) zone to the Sooke Business Park Industrial (M-SBP) zone in order to add business office and support services, private fitness clubs and licensed medical cannabis production facilities as permitted uses (proposed Bylaw No. 4234).

The Land Use Committee considered the application at their meeting of April 17, 2018 and recommended referral to agencies and the Otter Point Advisory Planning Commission.

The Otter Point Advisory Planning Commission considered the application at its meeting of June 5, 2018.

The LUC will consider re-referral of the application to agencies and the Otter Point Advisory Planning Commission at its December 17, 2018 meeting.

Rezoning Application RZ000253 - Lot 2, Section 97, Sooke District, Plan 15036 (6400 Block East Sooke Road)

The Juan de Fuca Land Use Committee (LUC) considered the request to rezone the subject property from Rural A to a new Rural Residential 6A (RR-6A) zone, in order to facilitate a 9-lot subdivision at its July 17, 2018 meeting. At this meeting the LUC amended proposed Bylaw No. 4246 to strike “Veterinary Clinic” and “Animal Hospital” as permitted uses and directed referral of proposed Bylaw No. 4246, as amended, to agencies and the East Sooke Advisory Planning Commission.

The East Sooke Advisory Planning Commission considered the application at its meeting of August 8, 2018.

The Juan de Fuca Electoral Area Parks and Recreation Advisory Commission considered the application at its meeting of September 25, 2018.

The LUC recommended that Bylaw No. 4246 be given first and second reading and direction to proceed to public hearing at its meeting of October 9, 2018.

The CRD Board gave Bylaw No. 4246 first and second reading and direction that the bylaw proceed to public hearing at its meeting of November 14, 2018.

Official Community Plan Amendment and Rezoning Application RZ000252 - Lot 1, District Lot 17, Renfrew District, Plan VIP57304 (Osprey Place)

The Juan de Fuca Land Use Committee (LUC) considered the request to re-designate the subject property from Residential (R) to Tourism Commercial (TC), and to rezone the land from Community Residential – One (CR-1) to Tourism Commercial - One (TC-1), in order to provide guest accommodation in conjunction with an existing fishing guide business at its July 17, 2018 meeting. At this meeting the LUC recommended that proposed Bylaw No. 4254 be referred to agencies and to a public information meeting.

Rezoning Application RZ000251 – Lot 12, District Lot 17, Renfrew District, Plan 13240 (17239 Parkinson Road)

The Juan de Fuca Land Use Committee (LUC) considered the request to rezone the subject property from the Community Residential – One (CR-1) zone to a new Mixed Commercial/Residential (CR-1A) zone (proposed Bylaw No. 4216) for the purpose of allowing a food service establishment at its January 16, 2018 meeting. At this meeting the LUC recommended that proposed Bylaw No. 4216 be referred to agencies and the Port Renfrew Advisory Planning Commission (APC).

A public information meeting was held on February 22, 2018.

The LUC recommended that Bylaw No. 4216 be amended to strike "Religious centres" as a permitted use and that Bylaw No. 4216, as amended, be given first and second reading and proceed to public hearing at its meeting of June 19, 2018.

The CRD Board gave Bylaw No. 4216 first and second reading and direction that the bylaw proceed to public hearing at its meeting of July 11, 2018.

A public hearing was held on August 9, 2018.

The CRD Board adopted Bylaw No. 4216 at its September 19, 2018 meeting.

Rezoning and Official Community Plan Amendment Application RZ000245 - Block 1043, Malahat District (3950 Goldstream Heights Drive)

The Juan de Fuca Land Use Committee (LUC) considered the request to rezone the property from the Greenbelt 2 (Gb2) zone to a new Commercial Recreation – Medical Marihuana (CR1-MM) zone (proposed Bylaw No. 4196) and to designate the property as a Commercial Development Permit Area (proposed Bylaw No. 4197) in order to permit a campground facility, tourist cabins, outdoor amusement facilities, and a licensed medical marihuana production facility pursuant to Health Canada’s Access to Cannabis for Medical Purposes Regulations (ACMPR) at its July 18, 2017 meeting. At this meeting the LUC recommended that proposed Bylaw No. 4196 and Bylaw No. 4197 be referred to agencies and to a public information meeting.

A public information meeting was held September 7, 2017.

At its meeting of January 16, 2018, the LUC considered a modified application to rezone the property to a new Industrial - Medical Marihuana Production (M4) zone (proposed Bylaw No. 4196) and to designate the property as a Commercial and Industrial Development Permit Area (proposed Bylaw No. 4197) for a licensed medical marihuana production facility, as well as to receive referral comments from agencies and the public information. At this meeting the LUC recommended that the revised proposed Bylaw Nos. 4196 and 4197 be referred again to agencies and to a public information meeting.

Comprehensive Community Plan Amendment Application RZ000242 (Pacific Gateway Marina)

The Juan de Fuca Land Use Committee (LUC) considered the request to redesignate the following properties from Marine Protection (M) and Residential (R) to a new Pacific Gateway Marina (PGM) designation, and to rezone the subject properties from Marine (M) and Community Residential – One (CR-1) to a new Pacific Gateway Marina Comprehensive Development (PGM-CD) zone, in order to permit a mix of community uses, year-round residential accommodation, vacation properties, and commercial tourism, recreation and marina services to the general public at its September 18, 2018 meeting.

  • That Part of Section 97, Renfrew District as Shown Coloured Red on Plan 344R (PID: 009-592-342);
  • Lot 1, Section 97, Renfrew District, Plan EPP24972 (PID: 028-991-125);

At this meeting the LUC amended proposed Bylaw No. 4096 to add fish processing as a permitted use to the PGM-CD zone and directed referral of proposed Bylaw No. 4096, as amended, to external agencies. Bylaw No 4096 will also be referred to a public information meeting in Port Renfrew.

East Sooke Official Community Plan Review

The LUC reconsidered proposed Bylaw No. 4000 at their meeting of April 17, 2018 and recommended that Bylaw No. 4000 proceed to first and second readings and to public hearing. The CRD Board supported this recommendation at their meeting on May 9, 2018.

A public hearing was held on Monday, May 28, 2018 at 7pm at the Juan de Fuca Local Area Services Building. See the Public Hearing Notice-BL4000 for more information.

The CRD Board gave Bylaw No. 4000 third reading at its meeting of June 13, 2018.

The CRD Board adopted Bylaw No. 4000 at its meeting of July 11, 2018.

Shirley/Jordan River Official Community Plan Review

The LUC reconsidered proposed Bylaw No. 4001 at their meeting of April 17, 2018 and recommend giving first and second reading and proceeding to public hearing. The CRD Board supported this recommendation at their May 9, 2018 meeting.

A public hearing is scheduled for Monday, May 28 at or near 7pm at the Juan de Fuca Local Area Services Building. See the Public Hearing Notice BL4001 for further information.

The CRD Board gave Bylaw No. 4001 third reading at its meeting of June 13, 2018.
