Bylaws in the Southern Gulf Islands
Overview
Bylaws pertinent to the Electoral Area the Southern Gulf Islands include Animal Control, Noise, Unsightly Premises, Soil Deposit and Removal and Building Regulation. As the Southern Gulf Islands are unincorporated, they are not subject to many of the bylaws in effect in the incorporated municipalities of the CRD.
Region-wide bylaws in the CRD which are applicable to the Electoral Areas include Water Scheduling (for those on a CRD water system), Parks Regulations, Watershed Regulations and Blue Box Scavenging. Four additional bylaws, Sewer, Landfill, Composting Facilities and Clean Air, apply to businesses.
The Islands Trust administers each island's Official Community Plan and regulates all land use through a powerful Local Trust Area Committee. Islands Trust bylaws pertain mainly to land use, ecosystem protection and development and construction of buildings and structures. The Islands Trust has its own bylaw officer to enforce issues around land use planning. On occasion, these officers will work with CRD bylaw officers on complaints which pertain to CRD bylaws.
Bylaw Contraventions
Bylaw offences can be handled in a number of ways. Infractions may result in:
- Verbal warnings
- Written warnings
- Municipal fines
- Court appearances under the Offence Act
- Court injunctions
