The Public Hearing to consider proposed Bylaw No. 3755 and Bylaw No. 3783 was held September 6, 7 and 8, 2011 as outlined in the Notice of Public Hearing.

Marine Trail Holdings Ltd. Proposed Resort Development Zoning Application updated

Proposal History

An application for rezoning was submitted in April 2009 for District Lot (DL) 568 (Z-02-09) to permit 132 cabins, a caretaker residence, an office and common building, and DL 567 (Z-03-09) to permit 126 Recreational Vehicle sites, a 60-unit lodge, caretaker residence and office and common building. This proposal was considered at the April 21, 2009 Juan de Fuca Land Use Committee (LUC) and was referred to agencies and all of the Juan de Fuca Advisory Planning Commissions (APC).

The applications were considered at the APCs and at the Juan de Fuca Electoral Area Parks and Recreation Commission meetings.

The following responses were received from agencies and groups.

In June 2010 the applicant revised the two applications (Z-02-09 and Z-03-09) and submitted five additional applications DL 564 (Z-02-10), DL 565 (Z-03-10), DL 566 (Z-04-10), DL 569 (Z-05-10) and DL 570 (Z-06-10) which expanded the resort concept from two district lots to seven district lots. The proposal was for 279 cabins, a lodge, a recreation centre and 11 caretaker residences.

The revised proposal was considered at the September 2010 LUC meeting and was referred to agencies and to a public information meeting. A public information meeting was more effective in communicating issues, responding to questions and obtaining an indication of any concerns as opposed to the traditional process of referring the application to Advisory Planning Commissions.  All Juan de Fuca Land Use Committee and Advisory Planning Commission members were invited to attend and the information meeting was advertised locally and regionally.

The applicant revised the proposal based on referral agencies and public comments received. The proposal was now for

  • 257 cabin units
  • Six single family caretaker residences
  • A lodge building with restaurant, retail store, meeting rooms and spa services
  • Two recreation centres
  • Approximately 33 ha (81 ac) to be developed
  • Approximately 98 ha (243 ac) of land to be dedicated to BC Parks
  • Approximately 105 ha (259 ac) of land to be protected land
  • amenities including two public trail access points to the Juan de Fuca Marine Trail, public parking for trail users, access to the Pacheedaht First Nation to Cultural Lands, a helipad site, three water reservoirs

The revised proposal was considered at the February 15, 2011 LUC meeting and was re-referred to agencies and a second public information meeting to obtain public comments.

Status Of Proposal

The proposal was considered at the April 19, 2011 LUC meeting. At this meeting the Juan de Fuca Land Use Committee made a recommendation to the Capital Regional District Board to give 1st and 2nd reading to the proposed zoning amendment bylaw (Bylaw No. 3755) and direct it to a Public Hearing.

At the May 11, 2011 meeting the Board deferred consideration until the June meeting.

The draft zoning bylaw and the Phased Development Agreement bylaw was to be considered at the June 15, 2011 CRD Board meeting. However, the item was deferred pending discussions between the CRD Board Chair and Vice Chair and Minister Chong and was to be considered at the June 29, 2011 meeting. The Board report is attached to the June 15 Board meeting agenda. However, due to time limitations the June 29th meeting was adjourned and the item was considered at a July 13 meeting. At that time Committee A gave 1st and 2nd readings to the proposed zoning Bylaw No. 3755 and the proposed Phased Development Agreement Bylaw No. 3783, and directed them to a Public Hearing.
